Privacy Policy

Since May 2018 the General Data Protection Regulation (GDPR) has been in force. We have always treated your personal data with the same care that we give to making your stay in our hotel a pleasant one and is no less than you are entitled to expect. In this Privacy Policy, we explain how we use your data.

 

1.    Basic Principles
This Privacy Policy applies to all persons who avail themselves of the services offered by Austria Classic Hotel Wolfinger, Hotel Wolfinger GmbH (hereinafter referred to as Hotel Wolfinger). In it, we inform you of the type, scope and purpose of the collection and use of your personal data by our company. We respect your privacy and make every effort to comply with the legal requirements governing the processing of your personal data (EU regulation 2016/679 [GDPR], Austrian Data Protection Act 2000, Austrian Data Protection Act 2018 and Austrian Telecommunications Act [TKG] 2003) in every respect. This legislation forms the foundation for processing all your personal data.

By using our services and consenting to the terms of this Policy, you confirm that you are at least 14 years of age and are legally able to give consent or that valid consent has already been given by your legal guardian.

 

2.    Information in Accordance with Art. 13 and Art. 14 GDPR 
(Information to be provided where personal data are collected from the data subject)
Your personal data, consisting especially of

  • your core data (family name, first name, address, e-mail address, telephone and fax number, date of birth, customer number), language and vehicle registration number,
  • information contained in travel documents (passport number, passport details, date of birth, issuing office, expiry date, nationality) and ID cards such as driving licences and including information on the issuing office and expiry date,
  • data relating to the method of payment and payments made, in particular by EC cards, credit cards and cash cards,
  • the desired length of your stay and destinations in connection with your stay, hotels, contacts, terms and rates, special services, health-related information, frequent flyer number, personal preferences that you tell us about,

and

  • special data categories such as health-related information and data relating to special needs and your civil status,

are required for performance of our services. This also includes the booking of trips, hiring of tourist guides, restaurants, catering services and vehicles as well as transfers, registration processing, insurance, events, tours, accreditations, vouchers including entries in the customer database, billing and verification thereof (B2B, B2C, FIT), ticket bookings, etc.

These data are stored, processed and, where necessary, transferred to third parties for the purposes listed. Such third parties are those we cooperate with to provide you, as our customer, with a service that is as efficient and good as possible, and may include service providers in third countries acting as processors and software and agency service providers.
 

The legal basis of these data processing activities is

  • the fulfilment of our obligations towards you for the purposes of entering into a contract or arising from a contract,
  • any consent obtained from you or given by you,
  • legal, contractual or other obligations by which we are legally bound (e.g. statutory rights and obligations to keep records in accordance with accounting principles, tax and customs law, contract law, registration law, legal disputes as well as § 96 TKG

and

  • our legitimate interests (e.g. the improvement of our customer service also with regard to direct marketing or pursuance of our own legal interests).

The duration of data storage is calculated according to the length of our business relationship, the consent you have given and beyond that the legal periods of retention and legal obligations by which we are bound. We stress that in the case of regular cooperation with a view to providing the best possible customer service it is our aim to know the wishes you have already submitted to us as our customer so well that we can satisfy you constantly and in the long term.

If it was not you that arranged and booked your stay but a third party (e.g. family member, colleague, service provider such as a travel agency etc.) we will collect and process the personal data you provided to that third party.

3.    Our Website
When you visit our website, your access data are automatically collected and stored. These access data can in particular include the page visited, files viewed, date and time of your visit, the user’s IP address, data of the retrieving computer (especially of the browser and the operating system), and the data volume and report on the successful visit. These access data are used for internal statistical purposes in order to guarantee the security of our services and to optimise them. In the event that an unlawful act is suspected the access data are analysed for the purposes of preservation of evidence.

When you enter your personal data in one of our contact forms, you consent to the transfer of these data to us and their storage by us for the duration of the processing of that particular inquiry. This applies particularly to inquiries sent to us via a contact form, internet chat and e-mail. We require these data to process your inquiry and in such cases also store your IP address for the purposes of preservation of evidence. Data are stored for as long as this is necessary to deal with any additional or subsequent questions that either you or we may have.

If you open a web account with us, we will make your contractual information available to you online. Please keep your access data safe and make sure that no unauthorised persons gain access to your account. We accept no liability for instances of unauthorised access which are attributable – even only partly – to an error on your part.

If you book your stay at the Austria Classic Hotel Wolfinger online you will automatically be rerouted to the website of our service provider “cbooking.de” which will then deal with your booking on our behalf. Your data will be transferred via an encrypted internet connection (https). We accept no liability in the event that your data are lost or accessed by a third party provided that we have met the security standards required by current technology.

The legal basis of this data processing is your consent, fulfilment of our obligations towards you for the purposes of entering into a contract or arising from a contract, our legitimate interests and legal obligations of all kinds, and § 96 TKG.

 

4.    Information About our Website
The content and programming of our website are protected by copyright and industrial property rights. Copying, even in part, and communication to the public, in particular copying of texts, extracts from texts, graphics or photographs, require the prior written permission of Hotel Wolfinger.
We make every effort to ensure that the information contained on this website is correct. However, we assume no liability and give no guarantee for the currency, accuracy and completeness of the information provided. Further, we accept no liability for the content of external websites that can be accessed from our website by hyperlink.

All products, services and quotations are non-binding. We reserve the right to change, add content to or delete services offered on this website or to cease publication either temporarily or permanently of this website without prior notice.

 

5.    Transfer of Data to Third Parties / Obligations of Processors
Under certain circumstances, we will pass on your personal data

  • to processors (e.g. for administering bookings and payments for accommodation and/or services, for monitoring the website etc.)

and to
third parties whom it is necessary to engage in order to perform the services you desire. All these third parties have pledged to comply with currently valid privacy standards. If it is not possible to comply with European privacy standards – for instance because, in a specific case, standard contract provisions, adequacy decisions or certifications are not guaranteed – we will notify you in good time and will ask you to give the requisite consent. 6.    Cookies and Tracking Services
We use cookies, small pieces of data used to store information in web browsers. Cookies are placed the first time you visit our website. The next time you visit, the cookies that were placed are recognised and are extremely useful for speeding up page loading and making it easier and more convenient for you to use our services. The information about you that the cookies recognise helps to identify you and to analyse your user behaviour. It is stored on the server of the provider concerned who, as a processor, has pledged to comply with the relevant privacy standards.

Once you have visited our website, cookies are stored on your terminal unless you elected not to accept them before or actively delete them. Actively deactivating cookies can reduce our website’s functionality for you. You can also prevent the storage of cookies by adjusting your browser settings accordingly. Please note that by doing so you may not be able to use all the functions of our website.

In addition, you can block the transfer of the information generated by the cookie and relating to your use of the website (incl. your IP address) to Google and the processing of this information by Google by downloading and installing the browser plug-in available at google.com. In order to make our web presence as informative and convenient for you as possible we also use content on the website that has been provided by third parties. This includes Google Maps and YouTube. For technical reasons, these providers receive your IP address. We have no influence over the way these third parties use your data and refer you to the privacy policies of the providers concerned.

Use of Google Maps
On our website, we use services provided by Google Maps. Google Maps is operated by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter referred to as “Google”). This enables us to display interactive maps on the website itself and to make the map function easy for you to use. The legal basis for incorporating and using Google Maps, and for the accompanying transfer of data to Google, is your consent (Art. 6 [1] [a] GDPR). Provision of your personal data is voluntary and occurs solely on the basis of your consent. If you block access to it, you may be able to use fewer website functions.

When you visit the website, Google receives the information that you have visited the sub-page of our website into which Google Maps is incorporated. This information is transferred regardless of whether Google has provided a user account that you have used to log in or no user account exists. If you are logged in to Google, your data is linked directly to your account. If you do not want Google to assign the information collected about your visit to our website to your Google profile you must log out of Google before you click on the button. Google stores your data as usage profiles and uses them for the purposes of advertising, market research and/or needs-based website design. This analysis is carried out in particular (and even for users who are not logged in) for the purposes of needs-based advertising and to inform other users in the social network of your activities on our website. You have the right to object to the creation of such usage profiles. However, you must notify Google directly of your objection. We do not collect any personal data through the incorporation of Google Maps. If you do not want Google to collect, process or use any data about you from our website, you can deactivate the “JavaScript” settings in your browser. However, doing this means that you will not be able to use the map function on our website or only to a limited extent.

Using YouTube Videos
Some of our pages contain embedded YouTube videos. The operator of the corresponding plug-in is YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA (hereinafter referred to as “YouTube”). If you visit one of our website pages that has a YouTube plug-in, a connection is automatically established with the servers of YouTube. YouTube receives information about which pages you visit. If you log in to your YouTube account, YouTube can assign your surfing behaviour to you personally. You can prevent this by logging out of your YouTube account.

When a YouTube video starts playing, the provider uses cookies which collect information about user behaviour. The legal basis for incorporating YouTube and the accompanying transfer of data to Google is your consent (Art. 6 [1] [a] GDPR). Provision of your personal data is voluntary and occurs solely on the basis of your consent. If you deactivate the storage of cookies for the Google ad program you can also watch YouTube videos without being concerned that any such cookies will be stored on your computer. However, YouTube collects non-personal user information in other cookies as well. If you do not wish this to happen you must block the saving of cookies in your browser. If you block this access, you may be able to use fewer website functions.

Use of Google Analytics
We use Google Analytics, a web analytics service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Google Analytics uses cookies. The information generated by the cookie about your user behaviour is generally sent to a Google server in the USA and stored there. Within the European Union, your IP address is abbreviated beforehand and therefore anonymised or at least pseudonymised. Only in exceptional circumstances is the full IP address transmitted to a Google server in the USA and abbreviated there.

Google uses this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage. The IP address transmitted from your browser for Google Analytics will not be combined with other data at Google.

We use Facebook social plug-ins from the Facebook social network operated by the firm of Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland, and Facebook Inc., 1601 S. California Avenue, Palo Alto, CA 94303, USA. These plug-ins are buttons with which Facebook keeps track of visitors to our website. If the visitor is also registered as a user on Facebook and has logged in, more information is stored by Facebook. For technical reasons, Facebook also receives your IP address. 7.    Contact
You can ask for information about the personal data we have stored concerning you at any time and free of charge. As a data subject you also have the right to demand rectification or erasure of your personal data or the limitation of the processing of these data and to request data transfer and to object to the processing of your data, unless this contravenes a legal period of retention by which we are bound.
If you object to the processing of your personal data we will cease to process these data by implementing appropriate measures unless the processing continues to be necessary for legal or other compelling legitimate grounds.
